They don't have a case to present yet. Just a suspicion from an organisation that has not been formally commissioned to gather adequate evidence. This is almost a trial by media...again. We saw this and we saw that?

If there were to be a "court trial" and proof of a "cheat device" found then I expect a judge to rule on costs through an independent technical assessor. That starts with the DoT, not a bunch of lawyers...so called.

Not Nissan related, but a company called PGMBM Law are running ads on national television looking for Mercedes owners that want to make a claim.

This question about these so called “Lawyers Co’s“ is that it appears that there are easy ways to Earn a Quick Buck or Two. We are with the German CommerzBank and 10 years ago we invested some money for a 10 year period in a Rented EU Office Block in Brussels. Every year we have received our Investment Bonus from the Co., but just last month we received a Lawyers Letter asking us to fill out details of our Accounts / Lawyers / Details Info’ Bla Bla etc.....
I had never heard of the Lawyer Co., never dealt with them and therefore did not fill out the Formular. On approaching our Bank Management I was told this often happens and that these Lawyers we’re trying to discredit the Co. & Bank and then trying to gain some negative comments to earn some % of cash for themselves. So do you now trust Lawyers ? in the end the Lawyers did get a British Earful ! - Dave 😕

Yep...they have been after Merc, Renault and Nissan for a while. It is a fact that the manufacturers regulatory type approval test is: (AFAIK)

1. with a new vehicle stripped of pretty much all motion resistant elements (brakes/tyres finely adjusted and so on). No uphill stuff...straight line steady driving.
2. specific non real world usage tests etc. A sort of clean room arrangement on a specific test track....surface. A repeatable test baseline.

No vehicle meets whats "written on the tin" for normal day to day individual usage. Different loads, acceleration, speeds and so on. Include temperatures/elevations and prevailing winds.

Initial type approval is what its all about and followed by periodic MoT tests.

I'm guessing that these manufacturers have been in talks with national regulatory bodies (UK DoT) about this subject. Ad hoc vehicle testing and subsequent begging in the press isn't right.

Maybe we should wait a while to see the outcome of regulation tests; they may show up positive or negative for a cheat device? Although if proven for Renault-Nissan ?? how many of us will join the Claim Chain ?
