It appears that your only option left to you is to seek a legal opinion.

Yeah, I think I'll have to as well. I have collected evidence, and this is a common issue. Which in itself, is evidence.

Make sure you seek out a lawyer that has some expertise in this area.

I've lost count of the number of us who've had new engines due to this fault now, at least 20 on the forums which makes you wonder how many outside the forums as well.

Always wondered what would happen once it happened to someone out of warranty, as there is enough evidence now that this is a known manufacturing defect, even down to the technical bulletins that someone posted about it.

Try Nissan GB customer services as your first port of call. This isn't a newly developed fault, your car has had it since day 1. And if they're saying it's not fit to be on the road, they are admitting you've been driving in a car for 3 years not fit to be on the road...

Hello

I would welcome advice on this topic please. I have this issue with my three year old 1.2 Quasquai. I took it to the local dealer just inside warranty and they'd said it was a known issue and the engine would be replaced under warranty. Nissan then rejected it as the service history was not exactly bang on. After a few heated phone calls they agreed to replace the engine as ' good will' if we payed the labour. This would be £89 per hour x 10 hours but we could maybe negotiate this with the dealer. I was going to swallow this. Dealer price has come back at £1400 which is much higher. Car is now just outside warranty. If it is a known issue I think they should pay for it. Where do I stand?

Did you buy the car out right or is it on finance? Was the deposit/car paid by credit card?

What did they object to on your service record?

You could always try another dealer?

It was bought outright and the deposit was paid on credit card - does that make a difference? The service history was at a dealer but over the specified miles:
12 months at 17k
12 months later at 31k
Due again in December but this issue is going on and don't want to service an engine that is coming out.

Just tried another dealer who will charge £1000 to change the engine supplied by a Nissan at their cost.
